Sony, among other studios, believes BD+ allows them to produce secure, yet consumer-friendly product, because only the hacker is punished for comprising copy-protection.

Microsoft mugged over VC-1 codec patent terms

We meet people on the various IPTV, mobile TV and web video circuits who always comment that VC-1, after a flying start, has fallen back and that pretty much these days the codec of choice is either VP6 from On2 Technologies for web video and H.264 for everything else, with no VC-1 in sight.

Just over three weeks ago the MPGE LA issued a final license for the Microsoft-inaugurated VC-1 codec, after forming a group to assess essential patents and to discuss terms for it, back in March 2004, the process taking precisely three years.

The license may in fact only be a license by which Microsoft can pay everyone else fees. There are no less than 16 separate companies that are deemed to have patents that are essential for VC-1 to work, the latest addition to the 15 company list that was first issued last August, being Korean number three handset maker, Pantech Curitel.

Between them they speak for 125 separate patents that are listed in the license, and a total of two of these are allocated to Microsoft. Every other supplier of essential technology including Daewoo, France Telecom, société anonyme (which presumably includes patents from close associates of France Telecom also) Fujitsu, Philips, LG, Matsushita, Mitsubishi, NTT Pantech Curitel, Samsung, Sharp, Sony, Telenor, Toshiba JVC, have more patents at stake that Microsoft (except for two of the above) and many of them have many more.

Effectively Microsoft has been mugged by the attempt to make its VC-1 technology a standard through the Society of Motion Picture and Television Engineers. In so doing it had to reveal how its codec technology worked, and offer a license, and in going to the respected MPEG LA as a patent pool agent, it exposed its technology to all the know how that went into licensing the MPEG 2 and MPEG 4 Level 10 AVC/H.264 codec that has stolen the market.

Usually all of the combatants (essential patent holders) will argue for some basis or other for splitting the royalty stream, and these rules are not public and they are not always the same. But as a general principle the more patents you hold, the bigger your slice of the patent pool pie. Now that’s not absolute, but it can be an indicator.

On that basis every company except Telenor and Sharp will end up getting more money when VC-1 is used, than Microsoft. Of course Microsoft can charge what it likes for any software implementation of its own, but since it has always chosen to “give away” its codec with its media player, this means that it has to cover any licensing bill for patents out of virtually zero direct revenue.

Microsoft's humbling over VC-1 shouldn't be under-estimated. When we last heard a Microsoft official speak about this back in 2004 they said that everyone should use VC-1 because it was charging less than MPEG4/H.264, but that was back when it thought that it owned all of the technology inside the codec.

It's no wonder that the use of VC-1 has fallen by the wayside. Why would Microsoft push it? The more successful it is in getting other people to use it, the more its rivals in the consumer electronics space get paid royalties.

When the patent pool was first put together and the negotiating began, both Sony and Philips were known to be considering taking legal action against Microsoft. They had already been successful in taking Microsoft to the patent courts in the US, over DRM, in support of their acquisition Intertrust, where they won a $440 million settlement. In a way that’s more of less what they’ve won here.

Back in August when the draft license terms were issued, it was made clear that Microsoft was the only company that would have to pay “back payments” prior to 2006 (Microsoft has been bundling the same or similar technology in its PC operating systems for around 10 years).

The patent position for H.264 looks remarkable similar to VC-1, which isn’t too surprising since everyone we’ve spoken to says that the technologies are virtually identical anyway. Common patent holders for both the VC-1 patent pool and the H.264 pool include France Télécom société anonyme, Fujitsu, Philips, Matsushita, Mitsubishi, Samsung, Sharp, Sony, Toshiba, JVC and of course Microsoft.

Terms for building a device with the technology in splits into two formats, if it’s for a specific function in a CE device it costs nothing for the first 100,000 licenses; 20 cents each for up to 5 million licenses; 10 cents for all licenses above 5 million and there is a royalty cap of $5m a year. But if the royalty is for a PC operating system, which can of course be used for multiple applications, the cap is $8m.

If Microsoft is forced to pay back 10 years of back payment for royalties (as was suggested in the August 2006 draft license) then it would have an up front payment of something like $80m, divvied up between all 16 companies, and a continual $8m a year – for something that it was claiming it invented itself.

Content companies also pay license fees, and these also split into three, paid for title by title, where a customer pays for the service or product, and where customer either get encoded content for free, such as broadcast Television or as part of an overall subscription.

For this short videos under 12 minutes bear no royalty and thereafter pay the lower of 2% of the price paid for the video or $0.02 per title. This is for replicators of physical media, and service providers such as cable, satellite, video DSL, internet and mobile, for VOD, Pay per view and electronic downloads. This caps at $4.25 million a year until 2012, and rising after that.

Where remuneration is for other sources, such as advertising the licensee pays either a one-time payment of $2,500 per VC-1 encoder or an annual fee per of $2,500 per broadcast market where a market is at least 100,000 people or $5,000 per year per for a broadcast market up to 500,000 people and $10,000 a year for each broadcast market above 1,000,000 or more television households.

The two patents that were included for Microsoft as being essential for inclusion in the patent pool related to predictive image compression using a single variable length code for both the luminance and chrominance blocks and another for the efficient macroblock header coding.

Coincidentally we’re sure, a few days after the terms were finalized a number of US Broadcasters including NHK, TBS, NTV, TV Asahi, Fuji TV and TV all decided that they would adopt the H.264 encoding for their future programming.

This came after there were hiccups over the H.264 license which has also been in discussion for many months, and this was not thought to have related to the VC-1 patent pooling license finally being settled, although the terms of the license are virtually identical, based on a payment on a $2,500 one time fee for each encoder used.

So after all this time the two technologies, considered by many so similar as to be identical, now cost virtually the same to license as one another, much to the chagrin of Microsoft’s and contradicting its earlier statements. The intervening period of uncertainty has pretty much left VC-1 encoding only scarcely used, except a little on the web, with the exception of its use as an option in both High Definition DVD standards HD DVD and Blu-ray. But this only came about as a snub to the MPEG4/H.264 license, which at the time was thought to be too expensive.

HDTV DVD War Is Not Over

Editor's Note: Samsung this week said it would introduce a dual-format HDTV DVD player by year's end. The news has led some to speculate that the Blu-ray vs. HD-DVD war is far from over, including our HD Observer Joseph Whip..

Washington, D.C. (April 14, 2007) -- Looks like Sony was premature in their declaration of victory in the HD-DVD/Blu-Ray format war. Samsung's announcement of their dual format player is evidence that cracks are starting to form in the BD camp.

At this time last year, Samsung was proclaiming publicly that they were BD exclusive and had no plans to develop, manufacture and market a dual format player despite rumors to the contrary. Now they have formally announced their dual format player and have not ruled out selling an HD-DVD only player.

Why that change of heart?

Perhaps it is due to Sony's sales of the PS3 at prices substantially below what standalone BD players were selling for, cutting BD CE manufacturers such as Samsung and Panasonic off at the knees, as sales of standalone BD players are anemic at best. Samsung clearly can't be happy with this result. I can't imagine that Panasonic and Pioneer are happy with their sales either :blink: :P .

"The second reason is the Nielsen Videoscan sales numbers released by Sony which show how few discs of each format are selling. Despite the sale of over a million PS3 consoles, well fewer than a million BD discs have been sold since the sale of the first BD player, the Samsung BDP-1000, back in June 2006. The best that BD could do was Casino Royale, at less than 40,000 discs despite Sony's claim that they shipped 100,000 of those discs (Ljuger Sony för oss? :o ).

Many titles have sold less than 1000 copies, even some big titles such as Chicago. HD-DVD sales were comparable despite the fact that HD-DVD has sold somewhere under 250,000 players. Batman Begins and The Departed on HD-DVD have sold similar numbers as CR.

Given the number of players sold by each camp, one would have expected BD to far outsell HD yet they haven't. The attach rate of HD discs far surpasses that of BD.

With the recent sales triggered by the reduction by Toshiba of their A2 player to a MRSP of $399 and the upcoming release of The Matrix on HD-DVD only as well as the flurry of recently announced HD-DVD titles, it is not unreasonable to believe that HD-DVD sales will soon match or exceed those of BD, even with the BD exclusive releases of Cars, Pirates of the Caribbean 1 & 2.

What is clear is that, despite the protestations of Sony and Fox to the contrary, the format war is not only not over but far from it. In fact, one can see the two formats existing side by side for years. It would be difficult to see were that to be the case, why BD exclusive studios such as Fox and Disney would want to remain so and ignore sales of their content to HD-DVD buyers, losing out on significant profits. Remember that Fox and Disney also supported the failed DIVX format as well and then supported DVD.

Maybe they have made a similar mistake in this format battle?(Det är inte sant :D ) Should they switch, this war may in fact end, with BD on the losing side."

Löjligt, alla fattar väl att alla inte vill använda sin PS3 för att spela upp filmer, så länge BD säljer bättre så kan jag inte förstå hur man kan vinkla det till HD DVD's fördel.
Sen jämföra CR och BB Begins, snygg :o Dom har ju varit ute lika länge eller hur? :blink:

EDIT: Om Samsung tror att dom ska få sälja hur mycket som helst av sin nya spelare så får dom nog tänka om, anledningen till att många skippade deras spelare var ju att PS3 är bättre. HD DVD köpare är ju dom som tjatar mest om pris, Strap-on, $199 kina-spelare osv, så räkna inte med den skaran. Nä dom får fan ta tag i saken och bygga en bättre spelare än PS3 istället för att bara sitta och gnälla.

Maybe these variations Amir is speaking of have to do with exactly that, spin rate.

I just don't see any real advantage to increasing size and bandwith other than bragging rights over BR. One thing for sure is that pending that, BR will have no physical/programming advantage left, and the only hurdle to overcome for HD DVD would be studio support. It will take one defecting studio to change the ball game, after that it's status quo forever. And seeing how Samsung's Duo Player is now official, we can all see where this is going...

My guess would be TL51 is actually a reasonably conservative step (meaning fairly risk free) that should do the job if the job can be done. At worst, it would open the door to higher capacities for SL and DL.

I see the x1.5 as being completely up in the air as Toshiba hasn't formally said a word about it -- it very definitely DID talk about TL51! So maybe X1.5 will end up in HD DVD's pocket, but I'm pretty sure TL51 will (as well as SL17 and DL34).

My 2 cents

"The Korean consumer electronics manufacturer said Friday it expects to have a dual-format machine that will play Blu-ray Disc and HD DVD software in stores in time for the holidays.

Dongsoo Jun, executive vp of the Digital AV Division at Samsung Electronics, said his company also "is flexible to market a stand-alone HD DVD player whenever consumers demand it."

"Our main concern is not technology but consumer choice," he said. "Consumers are hungry for more HD content but are currently confused about competing formats."

The fact that Samsung, which for so long has been an exclusive Blu-ray supporter, is going the dual-format route "is an acknowledgment of the tremendous value that HD DVD brings to the early adopter of high-definition-packaged media," he said.

Kornblau and other HD DVD supporters believe the imminent entry into the open-platform HD DVD market of low-priced players from Chinese consumer electronics manufacturers will ultimately tip the scale in favor of that format.

"Look what affordable players did for DVD," Kornblau said. "DVD didn't really go mass market until the Chinese :) came in."

"This is fantastic news and will hopefully spell the beginning of the end of this format war headache. But the repercussions for the industry are also interesting. If these dual-format players do become the norm, then which format is REALLY going to "win"? HD DVD discs are cheaper to produce and offer better interactive features than the Blu-ray format, so if single-format players are to become a thing of the past, will all studios quietly shift over to producing HD DVD discs, and use Blu-ray media in special circumstances only (for example, when the extra space is actually required)?

Well done Samsung. All we need now is for Sony to make a dual format player. After all, their first Network Walkmans only played their ATRAC audio format. Now they play ATRAC as well as competing standards like MP3, AAC, and even WMA

Det är ju uppenbart att paidgeek syftar på deras nya s500 som ska komma till hösten, s300 ska inte klara 1.1 profilen som tidigare sagts. Har svårt att tro att paidgeek skulle sitta och säga,
"nä men, det kommer en spelare från *valfrittnamn* i juli, bara att köpa den då"
Sony var inte först ut med standalone och jag tror inte dom kommer vara först ut med 1.1 heller...

Det får du gärna göra, som sagt, kan Gen1 spelarna läsa alla 3 lagar i all dess kapacitet och på samma gång i 1.5x, då blir jag riktigt impad. Det betyder ju att man kan använda hela skivan för filmerna.
OM Dessa öht når ut på marknaden och inte slutar lika som TL45, så tror jag det kommer bli så att nya spelare kan spela upp dom nya skivorna men gamla spelare kan fortfarande bara läsa 2 lager. Detta begränsar ju filmerna nå enormt, vafan ska man göra på sista lagret? Extramaterial kanske...

Det är lustigt att alla bara säger att HD DVD duger till allt, man behöver inte mer än 30GB, och nu när detta kommer upp så blir alla så exalterade :o :)

Pratar om HD-DVD drivers max läshastighet (G1,G2) B)...1.5x är läshastigheten med TL-51 skivan, hänger du med nu Elmo ;) :lol:

*TL-51n har kommit fram för de kräsna Disney, Fox :o (högre bitrate/kapacitet än BD :D )

Anledningen till att HD DVD:n av Dragon's Lair blev försenad:

Why did you guys go with Blu-Ray instead of HD-DVD?

DF: We still do have intentions of coming out with HD-DVD. There are just challenges in terms of the hardware that is out there right now, in terms of compatibility. Similar issues to the BD-J issues, but a little bit more severe. So we're sort of waiting that one out until there is a little bit more maturity. There's a couple of movies out there that aren't running particularly well on HD-DVD. Children of Men is one. The issues are the firmware implementations and the other is the development and technology.


När inte ens Toshiba kan lyckas göra spelare som är fullt kompatibla så kan man ju börja undra hur det ska gå när de omtalade Kina-spelarna dyker upp :)
